1. Acceptance of Terms

By accessing or using Ludiza, a product of Thinkdata BV, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use Ludiza.

2. Vision and Usage

Ludiza’s vision is to help couples discover new things in a supportive and safe environment. It is essential that the usage of Ludiza is consensual and not done forcefully or against anyone’s will, ensuring that Ludiza remains a safe space for all users.

Ludiza, nor Thinkdata BV, is liable for any damage done physically or mentally due to the use of the app. Users are responsible for ensuring their well-being and mutual consent while using the app’s features and participating in assignments.

3. Intellectual Property Rights

Ludiza, including its content, features, and functionality, is owned by Thinkdata BV and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The assignments provided within Ludiza are not to be copied, replicated, or used in any other formats or through any other platforms than the Ludiza app. Any unauthorized use of Ludiza’s intellectual property is strictly prohibited.

4. User Conduct and Responsibilities

Users are responsible for maintaining the confidentiality of their account information. Sharing of account details with multiple users is prohibited.

Any misconduct or misuse of Ludiza, including but not limited to, violating these Terms of Service or any applicable laws, will result in the termination of the account.

5. Purchase and Payment

Ludiza is a paid subscription-based application. Ludiza offers a monthly and annual recurring purchase which both grant unlimited access to all our content. The purchase will be applied to your iTunes or Google Play account at the end of a one-week free trial.

Subscriptions will automatically renew unless canceled within 24-hours before the end of the current period. You can cancel anytime with your iTunes or Google Play account settings. Any unused portion of a free trial will be forfeited if you purchase a subscription.

The payment is non-refundable, except as expressly set forth in these terms.

6. Refund Policy

Users are eligible for a refund if no more than 20% of the assignments have been played, and the purchase was made no more than 14 days ago.

Refund requests must be submitted through support@ludiza.com, and users are required to provide payment details. Refunds are issued through the original payment method only, with no option for store credit.

The processing of a refund may take up to 5 – 10 business days.

7. Data Privacy and User Content

Please refer to our Data Privacy Policy for detailed information on how we collect, use, and protect your personal information.

If a user deletes their account, all associated content will be deleted as well.

8. Customer Support

Users can reach customer support at support@ludiza.com. The expected response time is 1-2 business days.

9. App Updates and Modifications

Ludiza is a continuously evolving application, featuring regular updates, bug fixes, new features, and modifications to enhance user experience and improve service quality.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Thinkdata BV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use Ludiza.

11. Indemnification

Users agree to indemnify, defend, and hold harmless Thinkdata BV, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to their use or misuse of Ludiza, violation of these Terms of Service, or violation of any rights of a third party.

12. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Netherlands, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in the Netherlands for the resolution of any disputes arising out sof these Terms of Service.

13. Changes to the Terms of Service

Thinkdata BV reserves the right to update or modify these Terms of Service at any time. Continued use of Ludiza after any such changes constitutes acceptance of the new terms.

14. Scope of Use and Professional Advice Disclaimer

14.1 Understanding the Scope of Ludiza

Ludiza is designed to support and enhance the relationship experience of couples through various features and assignments. It is important to understand that Ludiza is a tool for engagement and entertainment, not a replacement for professional advice or therapy.

14.2 Consent and Mutual Participation

All activities and assignments within Ludiza should be undertaken with the mutual consent of both partners. It is imperative that no individual feels compelled or forced to participate against their will. The spirit of Ludiza is to foster positive, consensual, and enjoyable experiences for both users.

14.3 Disclaimer of Therapeutic Services

Ludiza, created by Thinkdata BV, does not provide couples therapy, psychological counseling, or any form of professional therapeutic services. The content and activities offered in the app are not intended to diagnose, treat, cure, or prevent any psychological or relational issues.

14.4 Recommendation for Professional Assistance

If users are experiencing significant relationship issues, mental health problems, or any situation requiring professional intervention, they are strongly encouraged to seek assistance from qualified professionals. Ludiza should not be used as a sole solution for serious relational or personal challenges.

14.5 Limitation of Responsibility

While Ludiza aims to support positive relationship experiences, Thinkdata BV is not responsible for any outcomes resulting from the use or interpretation of the app’s content as professional advice. Users are responsible for discerning the appropriateness of using the app in their personal situations.

Ludiza may, from time to time, offer links or references to external resources or professionals for users seeking specialized assistance. However, Thinkdata BV does not endorse or take responsibility for the services provided by external entities or individuals.
